Yes and no. "TH" gives the aff the ability to define who the judge is (in theory). But since its not unusual for policy resolutions to start with THBT, its kinda neutral from a trichot perspective.

I was referring to the rest of the res. Because there is no action verb and "is" merely states a fact, it is a fact debate. The aff can only uphold the resolution as it is grammatically written. There is no command, implied or explicit, in the res. Thus it is fact. You could run it as value off the word "believes," but I wouldn't.

I have (fortunately) never seen a round like this. I just though it was interesting, because it encompasses a lot of different theory and paradigm issues.
